On order of registering petition against Dahal, SC says: Justice can’t be delayed forever for victims of conflict

Kathmandu, 5 March: The Supreme Court (SC)has once again made public the judicial view that the issue of getting justice for the conflict victims cannot be put on hold for an indefinite period of time.

The SC,  making its view public in writing today relating to its order on overturning the Supreme Court Administration’s decision not to register  the petition demanding arrest and investigation of Prime Minister Pushpa Kamal Dahal for this public admittance of killing 5,000 people during Maosit conflict.

On Friday, a joint bench of SC justices Ishwar Prasad Khatiwada and Hariprasad Phuyal had revoked the SC administration’s decision to not register the petitions brought by Maosit victims Kalyan Budhathoki and Gyanendra Aran.  The SC has emphasized that the state should not encourage impunity but should manage the results of the conflict in a judicial way within a reasonable time frame.

The SC has stated that “the suffering has not been addressed judicially, the Truth and Reconciliation Commission set up for transitional justice, the Commission of Investigation on Enforced Disappeared Persons and other mechanisms are yet to produce the expected meaningful results and such commissions are currently mostly inactive.”

“It seems that the petitioner raised the question regarding the reference to transitional justice and the fact that the murder of their relatives was not brought under the scope of the criminal law,” SC further said clarifying it.

The SC clarified its position as the CPN-Maoist earlier today indirectly threatened the concerned people saying  that the party rejects and condemns all kinds of activities against the Constitution and progressive achievements. It has claimed that registration of the petitions citing Dahal’s statement blatantly violates the freedom of expression granted by the Constitution and is against the basic principles of legal recourse.

Addressing an event organized at Khula Manch in Kathmandu on the occasion of Maghi on January 15, 2020, Dahal had refuted allegations that he had killed 17,000 people during the decade-long Maoist armed conflict but said that he would take responsibility for the deaths of 5,000 of those killed during that period. He had also said that he would take responsibility for all the good and bad things that happened during the armed conflict.
