Kathmandu, February 15: National Assembly lawmaker Bamdev Gautam has accused the Election Commission of committing a punishable crime in the presidential and vice-presidential elections.
He argued that the Election Commission had committed a great atrocity on the Nepali people as it had misinterpreted the constitutional provision of having a female and male as president and vice-president and surrendered to the ruling coalition, and held its election.
Speaking at a meeting of the Sustainable Development and Good Governance Committee under the National Assembly on Wednesday, Gautam said chief election commissioner Dinesh Kumar Thapaliya had given legitimacy to the election by misinterpreting the constitution. Gautam said that the Election Commission had made a wrong decision in the election by ignoring the precedent of the 2072 elections in which both men and women should be elected president and vice-president. He also cautioned the Election Commission not to interpret the Constitution.
“The Election Commission has surrendered before the present alliance government. No one has filed a case in the court against it. And it has actually become a punishable offence. Now there is also an internationally recognized issue; after setting a precedent, there can be no contradiction in the law. The 2072 presidential election has set a precedent. There must be one man and one woman, rather than what is stated in the Constitution. One of them must be from a different community. Male and female representation is compulsory. But it should not belong to the same community between the two. There should be two communities. And that precedent has been set. In such a situation, the Election Commission conducted that election. The Election Commission is part of it. Once upon a time, when we made an assessment, the Election Commission did not pay attention to it even when it was mentioned in history.
