Kathmandu, 7 January: The Supreme Court (SC) has refused to issue an interim order on a writ petition demanding Ravi Lamichhane’s suspension from the post of Deputy Prime Minister and Home Minister and MP on misuse of citizenship.
With the court’s decision, Lamichhane’s position as a Member of Parliament (MP) will remain intact even as the case is sub judice at the apex court.
The Constitutional Bench of Acting Chief Justice Hari Krishna Karki, justices Ishwar Prasad Khatiwada, Dr Aanand Mohan Bhattarai, Anil Kumar Sinha and Prakash Man Singh Raut took a decision not to issue interim order after conducting a preliminary hearing on Lamichhane’s citizenship row.
A writ petition was registered alleging that Lamichhane, chair, Rastriya Swatantra Party, took American citizenship without surrendering his Nepali citizenship and again, he used the old citizenship while contesting the election for the member of parliament on the 20 November election.
Petitioner Yubaraj Poudel had demanded the SC for suspending Lamichhane from acting in the capacity of an MP as he had not acquired a Nepali citizenship certificate after he renounced the document to become a US citizen.
The apex court is scheduled to hear further on the writ petition on January 25. Following the present court decision, until the final verdict from the apex court, Ramilachhane can continue his job without obstacles.
