Kathmandu, September 21: The Supreme Court has ordered the police not to routinely handcuff arrested persons. The court has ruled that handcuffs should be used only after an objective assessment of the risk that the arrested person may escape, resist arrest, or cause harm to themselves or others.
A joint bench of Supreme Court Justices Nahakul Subedi and Shanti Singh Thapa issued the order. The court said that persons who are arrested should not be handcuffed merely because they have been taken into custody if there are no circumstances making the use of handcuffs necessary.
Bivek Chaudhary, Roshan Aauji and Bikash Yadav had filed a writ petition at the Supreme Court, claiming that handcuffs had been used unlawfully. The Supreme Court issued an interim order directing that handcuffs not be used arbitrarily until a final decision is reached on the writ petition.
