
Kathmandu, July 11: The secretariat meeting held at the central office at Chyasal, Lalitpur, concluded that the government will be formed according to clause 2 of Article 76 of the Constitution.
“There is a clear provision in the constitution, the new coalition government with the Nepali Congress will be formed according to clause 2 of article 76 of the constitution,” UML deputy general secretary Pradeep Gyawali said after the meeting on Wednesday.
“Now they (Maoist Center) are deliberately trying to spread confusion,” Gyawali said.
If no party in the House of Representatives has a majority, a coalition government of two or more parties is to be formed according to Article 76, Sub-section 2 of the Constitution. Now the Chairman of the Maoist Center, Pushpa Kamal Dahal, is the Prime Minister according to the same clause. Dahal is taking the vote of confidence from the House of Representatives on July 12.
Since the Nepali Congress and UML are in the opposition, it is unlikely that Dahal will get the vote of confidence. There is a constitutional provision for automatic dismissal of the government if a vote of confidence cannot be obtained from the House of Representatives.
Maoist Center and other parties have been insisting that the government should be formed as per clause 3 of Article 76 of the Constitution after Dahal is relieved of his post. In this clause, the President appoints the leader of the largest party in the House of Representatives as the Prime Minister. UML states that the government will be formed only if two or more parties form a government according to clause 3. Gyawali said that since the NC and UML are trying to form a government together, a coalition government will be formed according to Article 76 (2).
