SC intervenes executive body; establishes judiciary supremacy

We cannot support the anarchism exhibited by Prime Minister K.P. Sharma Oli in the party as well as in the government. In the meantime, we cannot support anarchism demonstrated by other political leaders and constitutional organs.
Today, one section is celebrating joy feeling victorious from the court verdict, whereas, another section has become furious against the court for its bias decision. The fact is that both the sections have been defeated as the court has tried to amend the constitution. The already nonfunctional constitution has been further dysfunctional from the recent court verdict by giving a political decision against the spirit of the constitution. Those who are celebrating the victory will soon feel that their rights have already been abducted by the court.
The constitutional bench’s verdict for reinstatement of the House of Representatives along with the order for appointing NC president Sher Bahadur Deuba to the post of the prime minister is not only a political decision but also against the spirit of the constitution and multiparty democracy.
The verdict by the constitutional bench comprised of chief justice Cholendra Shumsher Rana and other judges Dipak Kumar Karki, Mira Khadka, Ishwor Khatiwada and Aanandamohan Bhattarai has undermined the existence of the political parties and tried to establish the assumption of a partyless democracy.
Moreover, the decision has further contributed to the continuation of political instability permanently.
In short, the already hopeless constitution has become further hopeless.
What next?
Following the court order, Sher Bahadur Deuba has become the Prime Minister. He has introduced a small cabinet.
According to the constitutional provision, Deuba should take a vote of confidence within one month.
The court has also paved the way for Deuba to bag a vote of confidence as those MPs who cross the floor while voting against the candidate of the rival political party will not be abided by the party whip.
The opposition alliance against K.P. Sharma Oli has planned for the formation of a national government in collaboration with the UML also.
In the UML, if the unity effort will materialize and if Oli will surrender to Nepal, the Madhav Nepal faction will support and join the government led by NC. In this way, Deuba will retain as the PM.
If the unification process of the UML party is derailed, the Madhav Nepal faction will split from the UML and support the government giving continuity to the government until completion of the full tenure of the House of Representatives.
Considering the formation of the opposition alliance against Oli, it is not an easy task for Deuba to move forward. the main driver of the cabinet will be Madhav Nepal and Pushpakamal Dahal Prachanda. Not to forget, there are Upendra Yadav and Baburam Bhattarai as well.
Oli faction’s fate:
Even if Oli will perform flexibility by implementing the 10-point agreement between Oli and Nepal in the process of keeping UML indivisible, Oli will remain as the powerless chief of the party as all the decisions will be subjected to be approved by Madhav Nepal.
Meanwhile, efforts for defaming President Bidya Devi Bhandari can also be done by registering an impeachment motion against her although the House has to endorse it through a two-thirds majority, she will immediately be suspended from the post.
