It is evident from the latest move of the Supreme Court, which on Monday asked the government to submit documents of the cabinet decisions taken by the governments led by Madhav Kumar Nepal and Dr Baburam Bhattrai to privatise various land plots of the government including Lalita Niwas in Baluwatar, Kathmandu.
Coincidentally, the SC sought the documents on the same day when Oli suspended senior party leaders Madhav Kumar Nepal and Bhim Rawal from party membership. And the SC’s decision to seek the document has been targeted to Nepal and Dr Baburam Bhattarai, the two critics of Oli.
A divisional bench of justices Anil Kumar Sinha and Hari Prasad Phuyal asked for four cabinet decisions made in April 2009, May 2010, August 2010 and October 2012 on the privatisation of the public property.
Former Prime Minister Madhav Kumar Nepal was leading the government in the first three dates and Dr Baburam Bhattrai in October 2012.
The bench of the Supreme Court was hearing the writ petitions filed by senior advocate Bal Krishna Neupane on Monday. “Submit the original copies of the documents of the cabinet decisions made on public lands from above-mentioned dates,” mentioned the order slip of the court. Neupane had filed the case demanding that the two former prime ministers be indicted on the charge.
Before this, the Commission for the Investigation of Abuse of Authority (CIAA) had indicted 175 individuals, including three former ministers, 57 former and serving government officials and 115 former and current owners and users of the land of Lalita Niwas on 5 February 2020.
However, the two former Prime Ministers — Nepal and Dr Bhattarai — were spared from the investigation stating that it was not appropriate to investigate cabinet decisions concerning government policy.
