It is shameful act of the government to arrest and keep prestigious industrialist, businessman and academician Dr Roop Jyoti under Police custody for several days on the charge of fraud on financial transaction.
Earlier, when Dr Jyoti was returning from Singapore, upon his arrival at the Tribhuvan International Airport on 8 November, he, along with his daughter, was arrested by the Police from the Airport.
For the first time, the Police received order from the Kathmandu District Court to keep him under the Police custody for three days. Again, on Sunday, 10 November, the Court gave another order to keep Jyoti under the Police custody for further five days.
Jyoti has remarked that this is an attempt to defame and demoralize him and his family.
The story behind:
Sanghu vernacular weekly reports, noted industrialist Jyoti has become victim of exhortation attempt of Home Minister Rambahadur Thapa’s son Prateek and Vice President Nandabahadur Pun’s son Deepesh.
Normally, the Police don’t look after the fraud cases, however, due to the pressure from the Home Ministry, the Police has started investigation on Jyoti on his alleged involvement in this fraud case.
There is no reason to keep Jyoti, a prestigious economist under Police arrest just on the charge of default transaction of 12.6 million rupees.
Reality:
Roop Jyoti’s family had invested in Landmark Developers for housing development in Maharajgunj. To note, they are the general share holders but not the board members of the Landmark Developers. CE Construction was assigned to construct the houses for the Landmark Developers. Shambhu Fuyel is the main owner of the construction company.
Bigendrakrishna Malla, a client, had paid in advance Rs 13.6 million rupees to the CE Construction to get a house on No. 19 plot. However, the CE Construction didn’t give the money to the Landmark Developers, therefore, the the Developers sold the Plot No 19 to another client.
The dispute started between Malla and Jyoti Group after Malla filed a case against Jyoty on the fraud case after the Developers sold the plot No 19. It is clear that the Developers could sell the house to the person who had paid money to the Developers. There was the mistake of CE construction for not providing the cash given by Malla to the Developers.
Malla when he didn’t get the house he had chosen, went to the Police on the charge of fraud against the Jyoti Group at the Durbarmarga Police Post. Jyoti went to the Kathmandu District Court against the complaint. The Court defined the case was related to financial transaction.
Then after, Jyoti’s family deposited the said amount worth 13.6 million rupees at the Court to handover the amount to Fuyel and Malla. The Court further demanded to deposit the court fee. That too, Rs. 136 thousand was paid to the Court by the Jyoti group.
Surprising to note that it was a case in which the Court had already defined as the case related to financial transaction, again, the Police had filed a fraud case against Roop Jyoti. And the Court has given the arrest order to the Police.
Reality:
Malla, instead of collecting money from the Court, where Jyoti had already deposited it, went to file a fraud case against Jyoti. The then SSP of the Kathmandu Police, Bashanta Lama, was seen supportive towards Malla. The reason was that Home Minister’s son Prateek and VP’s son Deepesh were behind Malla. They had the plan to collect 50 million rupees from Roop Jyoti and share fifty percent of the amount with Malla. Both sons of those in power, had abused power and compelled Lama to issue an arrest letter against Jyoti.
After filing the fraud case, Malla was found blackmailing Jyoti time and again with the support of the Minister’s son Prateek.
However, Jyoti, saying that he had never taken money from Malla, bluntly rejected to fulfill the demand of Malla.
The Prime Minister, who is trying to show a clean image, is unaware about such extortion attempt by those sons of the personalities in power.
Such an attempt against a prestigious industrialist has seriously hurt the business community in the country. FNCCI and Chamber of Commerce organised a demonstration against the arrest of Jyoti on Sunday at Maitighar Mandala. Both the business organizations have issued statements denouncing the arrest of Jyoti.
This is an example of daylight loot by the family members of those in power by abusing authority.
